Terms of service
1. Who we are
The Art Store (the-artstore.com) is operated by Elephant Parade Distribution Europe B.V., Rijperweg 30, 1464 MB Westbeemster, the Netherlands (distribution centre: Fortweg 3A, 1471 EB Kwadijk), Chamber of Commerce (KvK) 42059095, VAT number NL869520805B01 (“we”, “us”). These terms apply to every use of this website and to every order placed through it. Terms and conditions of the customer do not apply.
2. Business customers only
We sell exclusively to businesses that buy for resale or for use in their business. By applying for a partner account and by placing an order, you confirm that you act in the course of your business and not as a consumer. We decide at our own discretion whether to approve an application, and we may suspend or close a partner account at any time. Orders placed by customers without an approved partner account may be cancelled.
3. Your account
You are responsible for keeping access to your account secure and for all orders placed through it. Wholesale prices are shown only to approved partners and are intended for your own purchasing.
4. Prices
All prices are in euros. Where VAT applies, it is shown on the invoice. The suggested retail price (SRP) shown on this website is a recommendation only; you are free to set your own retail prices.
5. Orders and minimums
An order placed on this website is an order request. The contract is concluded once we confirm your order by email. Every order must have a minimum value of €500, as shown in the cart. Some products are sold in fixed multiples (for example per 2, 3 or 4); this is shown on the product page and applied in the cart. Stock levels on the website are indicative. If a product turns out to be unavailable, we will let you know and deliver the rest of the order, or cancel the order in consultation with you.
6. Payment
No payment is taken online. After confirming your order, we send you an invoice. Payment is due within the term stated on the invoice. If payment is late, you owe the statutory commercial interest (wettelijke handelsrente) and reasonable collection costs.
7. Shipping, delivery and retention of title
Shipping costs are not included in the order total. We calculate them once your order has been prepared for dispatch and share them with you before anything is sent. We deliver to the business address you provide; delivery times are estimates and not strict deadlines. The risk of the goods passes to you on delivery. The goods remain our property until all amounts owed to us have been paid in full.
8. Inspection and complaints
Please check your delivery as soon as you receive it. Visible damage, missing items or incorrect items must be reported to info@the-artstore.com within 5 working days of delivery, with your order number and photos. Other defects must be reported within a reasonable time after you discovered them. Our products are hand-painted: small differences in colour and detail between pieces, and between a piece and its photo, are part of the product and are not a defect. 9. Liability
Our liability is limited to the invoice value of the order concerned. We are not liable for indirect or consequential loss, including lost profit or lost sales. These limitations do not apply in the case of intent or gross negligence on our part.
10. Intellectual property
All designs, product images and texts remain the property of the artists, the brand owners or us. Any use beyond offering our products for sale in your own store requires our written permission.
11. Force majeure
We are not liable for delays or failure to perform caused by circumstances beyond our reasonable control, including transport disruptions, supplier delays, strikes and government measures.
12. Privacy
We process personal data in accordance with our Privacy Policy.
13. Changes
We may change these terms. The version published on this website at the time of your order applies to that order.
14. Governing law and disputes
These terms and all contracts with us are governed by Dutch law. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply. Disputes are submitted exclusively to the District Court of North Holland (Rechtbank Noord-Holland), the Netherlands.
